The Board of Education of the Pacific Grove Unified School District held a special meeting on May 9, 2002 at the Pacific Grove Middle School.

II. RECONVENE IN OPEN SESSION: 7:00 pm
A. Pledge of Allegiance: recited.
B. Adoption of Agenda: MOTION (Hall/Bray) to adopt agenda. Motion CARRIED 5 to 0.
C. Report Action Taken in Closed Session: No action taken.
III. COMMUNICATONS:
A. Written Communications: Mr. Perry distributed three letters to the Board Members that he had received in the past week.
B. Board Member Report: Mothershead the school year is drawing to a close and on Monday, May 13 the new ASB officers will be inaugurated. Shammas regarding the board's interest in responding to communication from the public Ms. Shammas read a letter from Richard Stillwell dated 1998 remarking on the state of our schools at that time. Hall attended the District Music Festival on Wednesday evening and was thoroughly impressed with the talented students we have in this district. Mrs. Hall also congratulated Mr. Stotz for his Music Educator of the Year award.
C. Superintendent Report: Nothing to report at this time.
IV. PUBLIC COMMENT: Judy Wills, teacher from Robert Down, commented on combination classes, switching schools and encouraged the Board to consider lower class size in 4th and 5th grade classes.
V. INFORMATION/DISCUSSION:
A. Administrative Law Judge Findings: On March 7, 2002 the Board of Education passed a resolution, which required administration to notify selected teachers in our school district that their services may not be needed for the 2002-2003 school year. As a result the noticed teachers requested an Administrative Hearing to review the procedures that the District had used in making this decision and in notifying personnel. An administrative law judge hearing was scheduled and conducted on April 24th. The administrative law judge took into consideration the testimony from the District and noticed teachers and informed the District that she would offer an opinion on or before May 7th. The judge's opinion arrived on May 3, 2002, affirming the District's actions.
B. 2002-03 Budget Review: Robin Blakley reported that the certificated employee group has reached a tentative agreement with the District. The Business Office now has an important component to place in the budget assumptions. With this component the need to make adjustments to the number of certificated positions in next year's budget was discussed. The Board can now consider the Management Team recommendation to not reduce a position at the Middle School and consider a reduction of four classrooms from K-5 grade level and not reduce the Preschool Teacher position. Board member Schramm noted that class configuration may vary based on enrollment. The Board directed Mr. Blakley to proceed with this assumption.
VI. ACTION ITEMS:
A. Resolution No. 696 Adoption Administrative Law Judge Findings: MOTION (Schramm/Shammas) to approve amended Resolution 696 to reduce or discontinue four elementary teachers currently in paid status and one elementary teacher currently on an unpaid leave, resulting in a total reduction of four elementary classrooms; retain the middle school classes and preschool position as currently constituted; adopts the ruling by Judge Rasmussen as attached (Exhibit A) and the Superintendent or his designee is directed to send final layoff notices to all employees listed on Revised Exhibit B, whose services shall be terminated by virtue of this action. Motion CARRIED 5 to 0.
